DETERMINATION OF PATERNITY

⚡️QUESTION:
I started a family with Sharia marriage. We have one child from our marriage. Currently, my husband and I do not live together. My husband did not adopt my child. I heard that paternity must be established before I want to give him alimony. Can I apply to the court to establish paternity for my child or do I need someone else's consent?

⚡️ANSWER;
Article 62 of the Family Code states that if a child is born to parents who are not legally married, paternity can be determined in court if there is no joint application of the parents or the application of the child's father.

👉 Determination of paternity in the court procedure is carried out according to the application of one of the parents or the guardian (sponsor) of the child or the person in whose care the child is, as well as the application submitted by the child after the child reaches adulthood.

✅ According to the above basis, you can apply to the court to determine paternity of the child. You don't need anyone's approval for this
