IS IT POSSIBLE TO RETURN A GIFTED HOUSE?
⚡️Question;
my father gave me his own two-room house to another person free of charge through a notary public. Can my father take back the gifted property from that person now?
⚡️Answer;
According to Article 507 of the Civil Code,
🟢 In cases where the recipient of the gift has committed an intentional crime against the life or health of the donor, his family members or close relatives, the cancellation of the gift is allowed in court.
🟢 In the event that the recipient of the gift intentionally kills the donor, the heirs of the donor have the right to demand in court the cancellation of the gift.
🟢 If the recipient's treatment of the gift, which has a large non-property value for the donor, threatens to destroy it completely, the donor has the right to demand the cancellation of the gift in court.
❗️ Based on one of the above reasons, your father or heirs may file a lawsuit and demand the return of the property sent as a gift.
✏️ Property donated simply because of a change of mind, a breakdown in a relationship and other imaginary reasons cannot be returned.
