Article 1 The purpose of this Act
This Law establishes the legal basis for education, upbringing, vocational training of citizens and is aimed at ensuring the constitutional right of everyone to education.

Article 2 Legislation on education
The legislation on education consists of this Law and other legislation.
Relations in the field of education in the Republic of Karakalpakstan are also regulated by the legislation of the Republic of Karakalpakstan.
If an international agreement of the Republic of Uzbekistan establishes rules other than those contained in the legislation on education, the rules of the international agreement shall apply.

Article 3 Basic principles of state policy in the field of education
Education is declared a priority in the field of social development of the Republic of Uzbekistan.
The main principles of state policy in the field of education are:
  • that education and upbringing are of a humane, democratic nature;
  • continuity and consistency of education;
  • compulsory general secondary, as well as secondary special, vocational education;
  • secondary special, vocational education: voluntary choice of study in an academic lyceum or vocational college;
  • the secular nature of the education system;
  • openness of education to all within the framework of state educational standards;
  • a unified and differentiated approach to the selection of educational programs;
  • encouraging knowledge and talent;
  • harmonization of state and public administration in the education system.
Article 4 The right to education
Everyone has equal rights to education, regardless of gender, language, age, race, nationality, creed, religion, social origin, type of service, social status, place of residence, length of stay in the territory of the Republic of Uzbekistan guaranteed.
Right to education:
  • development of state and non-state educational institutions;
  • organization of education separated from production and inseparable;
  • free education on the basis of state programs of education and training, as well as paid vocational training in educational institutions on a contractual basis;
  • graduates of all types of educational institutions have equal access to the next level of education;
  • by granting the right to citizens who have studied in the family or independently to pass the certification in the form of externship in accredited educational institutions.
Citizens of other countries have the right to education in the Republic of Uzbekistan in accordance with international agreements.
Stateless persons residing in the Republic have the same rights to education as citizens of the Republic of Uzbekistan.

Article 5 The right to engage in pedagogical activities
Persons with appropriate education, professional training and high moral qualities have the right to engage in pedagogical activities.
Recruitment of teachers to higher education institutions is carried out on a competitive basis in accordance with the Regulations approved by the Cabinet of Ministers of the Republic of Uzbekistan.
Persons prohibited from engaging in pedagogical activities by a court decision are not allowed to engage in such activities in educational institutions.

Article 6 Legal status of the educational institution
Accreditation of an educational institution is carried out by the authorized state body on the basis of certification.
The educational institution is a legal entity and is established in the manner prescribed by law. A non-governmental educational institution shall have the right to be a legal entity and engage in educational activities from the moment of its state accreditation in accordance with the procedure established by the Cabinet of Ministers of the Republic of Uzbekistan.
The educational institution operates on the basis of a charter developed in accordance with the legislation.
An educational institution may be deprived of state accreditation based on the results of attestation.
Educational institutions have the right to unite in educational complexes and in educational and scientific-industrial associations and unions.
Educational institutions have the right to provide paid educational services, as well as engage in other types of entrepreneurial activities in accordance with their statutory duties.

Article 7 State educational standards
State educational standards define the requirements for the content and quality of general secondary, secondary special, vocational and higher education.
Compliance with state educational standards is mandatory for all educational institutions of the Republic of Uzbekistan.

Article 8 Language of instruction
The procedure for using the language of instruction in educational institutions is regulated by the Law of the Republic of Uzbekistan on the State Language.

Article 9 Education system
The education system of the Republic of Uzbekistan includes:
state and non-state educational institutions implementing educational programs in accordance with state standards;
scientific and pedagogical institutions that carry out research necessary to ensure the functioning and development of the education system;
public administration bodies in the field of education, as well as their enterprises, institutions and organizations.
The education system of the Republic of Uzbekistan is unique and continuous.

Article 10 Types of education
Education in the Republic of Uzbekistan is carried out in the following types:
preschool education; general secondary education; secondary special, vocational education; higher education; postgraduate education; professional development and retraining; out-of-school education.

Article 11 Preschool education
Preschool education aims to form a child's personality in a healthy and mature way, ready for school. This education is provided in families, kindergartens and other educational institutions, regardless of the form of ownership, until the age of six or seven.

Article 12 General secondary education
The stages of general secondary education are as follows:
primary education (grades I-IV);
general secondary education (grades I-IX).
Primary education is aimed at forming the foundations of literacy, knowledge and skills necessary for general secondary education. Children are admitted to the first grade of the school from the age of six or seven.
General secondary education provides the necessary amount of knowledge, develops independent thinking, organizational skills and practical experience skills, helps to initially focus on the profession and choose the next stage of education.
Specialized schools can be set up to develop children's abilities and talents.

Article 13 Secondary special, vocational education
For the purpose of obtaining secondary special, vocational education, everyone has the right to voluntarily choose the direction of study in an academic lyceum or vocational college on the basis of general secondary education.
Academic lyceums and vocational colleges provide secondary special, vocational education, which gives the right to work in the occupied profession and is the basis for the continuation of such work or education at the next stage.
An academic lyceum is a three-year secondary special educational institution that provides students with a rapid development of their intellectual abilities, providing them with deep, differentiated and professionally oriented knowledge.
A vocational college is a three-year secondary vocational school that provides students with in-depth development of their professional inclinations, skills, and qualifications, and obtaining one or more specializations in their chosen professions.

Article 14 Higher education
Higher education provides training for highly qualified specialists.
Training of specialists with higher education is carried out in higher educational institutions (universities, academies, institutes and other educational institutions of higher education) on the basis of secondary special vocational education.
Higher education has two stages: a bachelor's and a master's degree, as evidenced by documents on higher education in the form approved by the state.
A bachelor's degree is a basic higher education degree with a minimum duration of study of at least four years, which provides a thorough knowledge of one of the areas of higher education.
A master’s degree is a higher education that lasts at least two years on the basis of a bachelor’s degree in a specific specialty.
Citizens have the right to receive secondary and higher education on a contractual basis.

Article 15 Postgraduate education
Postgraduate education is aimed at meeting the needs of society in scientific and scientific-pedagogical personnel. Postgraduate education can be obtained in higher education institutions and research institutions (postgraduate, adjunct, doctoral, independent research).
The procedure for training scientific and scientific-pedagogical personnel, awarding academic degrees and titles shall be established by legislation.

Article 16 Professional development and retraining
Professional development and retraining provide deepening and updating of professional knowledge and skills.
The Cabinet of Ministers of the Republic of Uzbekistan shall establish the procedure for advanced training and retraining of personnel.

Article 17 Extracurricular education
In order to meet the individual needs of children and adolescents, the organization of their leisure and recreation, government agencies, public associations, as well as other legal entities and individuals in cultural, aesthetic, scientific, technical, sports and other areas may establish educational institutions.
Extracurricular educational institutions include palaces, houses, clubs and centers of children's and youth creativity, children's and youth sports schools, art schools, music schools, studios, libraries, health facilities and other institutions.
The procedure for the operation of out-of-school educational institutions shall be established by legislation.

Article 18 Family education and independent learning
The state promotes family education and independent learning. Family education and independent learning of children are carried out according to the programs of the relevant educational institutions. Students are provided with methodological, counseling and other assistance by the competent state institutions.

Article 19 Documents on education
Graduates of accredited educational institutions are issued a document (certificate, diploma, certificate, certificate) in the form approved by the state. The state-approved information document is also issued to those who have been educated in the family or independently and have passed external examinations in the relevant educational programs of accredited educational institutions, state education except for specialties, the list of which is mandatory in educational institutions and the list of which is determined by the Cabinet of Ministers of the Republic of Uzbekistan.
Attached to the diploma of higher education is a sheet with a list of subjects studied, their scope and grades.
Defenders of the dissertation are awarded the degree of Candidate of Sciences or Doctor of Sciences in the prescribed manner and awarded a diploma in the form approved by the state.
In the case of compliance with state educational standards, on the basis of bilateral agreements between the Governments of the Republic of Uzbekistan and foreign countries, information documents of both parties may be mutually recognized in the prescribed manner.
Persons who have not completed the relevant level of education will be issued a certificate in the prescribed form.
The state-approved information document entitles the holder to continue his / her education in the next level of education or to work in the relevant specialty.

III. PARTICIPANTS IN THE EDUCATIONAL PROCESS SOCIAL PROTECTION

Article 20 Social protection of students
Students of the educational institution are provided with benefits, stipends and dormitory accommodation in accordance with the legislation and regulations.

Article 21 Employees of educational institutions social protection
Employees of educational institutions are provided with reduced working hours, extended paid annual leave and benefits provided by law.
Educational institutions have the right to independently set rates, stratified bonuses to salaries, and to use various forms of remuneration and incentives within the available funds for salaries.

Article 22 Orphans and their parents or other legal educating children left without the guardianship of their representatives
The education and upbringing of orphans and children left without the guardianship of their parents or other legal representatives shall be carried out in the manner prescribed by law on the basis of full state support.

Article 23 He had a defect in his physical or mental development educating children and adolescents
Specialized educational institutions will be established for the education, upbringing and treatment of children and adolescents with physical or mental disabilities, as well as those in need of long-term treatment. Admission and expulsion of children and adolescents to these educational institutions is carried out with the consent of parents or other legal representatives on the basis of the conclusion of the psychological-medical-pedagogical commission.
Students of specialized educational institutions are partially or fully covered by the state.

Article 24 In need of social assistance and rehabilitation educational institutions for individuals
Specialized educational institutions will be established for children and adolescents in need of upbringing and education in special conditions, providing them with education, vocational training and social rehabilitation.
Conditions shall be created in accordance with the procedure established by the legislation for the education and independent learning of persons detained in penitentiary institutions in the form of deprivation of liberty.

Article 25 Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of education
The powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of education include:
  • implementation of a unified state policy in the field of education;
  • leadership of public administration bodies in the field of education;
  • development and implementation of educational development programs;
  • establishment of the order of organization, reorganization and liquidation of educational institutions;
  • establishment of the procedure for accreditation of educational institutions, attestation of teachers, researchers;
  • issuance of permits to educational institutions of other countries to engage in educational activities in the territory of the Republic of Uzbekistan;
  • recognition of documents on education of foreign countries in accordance with the legislation and the establishment of the procedure for recording the equivalence of documents;
  • approval of state educational standards;
  • approval of information documents in the form approved by the state and determination of the procedure for their issuance;
  • determination of the amount of state grants and the procedure for admission to educational institutions;
  • appointment of rectors of state higher education institutions;
  • establishing the procedure for transferring students from one accredited educational institution to another;
  • other powers in accordance with the legislation.

Article 26 Special authority is given to manage education jurisdiction of state bodies
The jurisdiction of state bodies with special powers to manage education includes:
  • implementation of a unified state policy in the field of education;
  • coordination and guidance of educational institutions in matters of methodology;
  • ensuring compliance with state educational standards, requirements for the level of knowledge and professional training of specialists;
  • introduction of advanced forms of teaching and new pedagogical technologies, technical and information means of education in the educational process;
  • organization of publication of educational and methodical literature;
  • final state certification of students and approval of regulations on externships in public educational institutions;
  • submit proposals to the Cabinet of Ministers on the appointment of the rector of the state higher education institution;
  • organization of training, advanced training and retraining of teachers;
  • other powers in accordance with the legislation.

Article 27 Local public authorities powers in the field of education
Local authorities:
  • ensure that the activities of educational institutions meet the needs of socio-economic development of the regions;
  • establish, reorganize and liquidate educational institutions (except for the republican ones), register their charters;
  • determine the amount of funding and benefits for educational institutions in their territories within the competence;
  • ensure compliance with the state requirements for the quality and level of education, as well as the professional activities of teachers;
  • exercise other powers in accordance with the legislation.

Article 28 Educational institution management
The educational institution is headed by its head.
Public administration bodies may be established in educational institutions in accordance with the legislation.

Article 29 With public authorities in the field of education interactions between non-governmental educational institutions
Public administration bodies in the field of education control the observance of the legislation on education in non-governmental educational institutions.
In case of violation of the legislation on education by non-governmental educational institutions, the accrediting bodies have the right to suspend their activities in accordance with the legislation.
Admission to non-governmental educational institutions is carried out in the manner and terms established for public educational institutions.

Article 30 Duties of parents or legal guardians
Parents or legal guardians of minors are obliged to protect the legal rights and interests of the child and are responsible for their upbringing, pre-school, general secondary, secondary special, vocational education.

Article 31 Education financing
Financing of state educational institutions is carried out at the expense of means of the republican and local budgets, and also off-budget means.

Article 32 Education Development Funds
Education development funds may be established at the expense of voluntary contributions of legal entities and individuals, including foreign legal entities and individuals, in the manner prescribed by law.

Article 33 International cooperation
Educational institutions participate in international cooperation on educational issues, have the right to establish direct contacts with relevant educational institutions of foreign countries, to establish joint educational institutions with them in the manner prescribed by law.

Article 34 Legislation on education liability for violation 
Persons guilty of violating the legislation on education shall be liable in accordance with the established procedure.
