What to do to have a child?

Question: It's been 10 years since we've been married. But we still don’t have children. My husband and I agreed and decided to adopt a child. What kind of people have the right to have a child and what documents are required for this?

Answer: Adoption is allowed only in respect of minors and in their best interests.

Adoption of a child is carried out at the request of persons wishing to adopt and on the recommendation of the guardianship and trusteeship courts by the decision of the mayor of the district or city.

Only adults can adopt a child. Except for the following persons:

deprived of parental rights or restricted parental rights;

those who have been declared legally incompetent or with limited legal capacity in accordance with the procedure established by law;

those registered in neurological or narcological institutions;

previously convicted of intentional crimes.

The age difference between the adopter and the adoptive parents must not be less than fifteen years, except in cases of adoption by the stepfather and stepmother.

The following have the right of priority in adoption:

relatives of the adopted child, regardless of place of residence;

a person living in the family of the adopted child;

persons who adopt brothers and sisters without breaking the kinship between them;

stepfather and stepmother;

Citizens of the Republic of Uzbekistan;

persons separated from their children as a result of illness or accident.

Public education at the place of residence of the person wishing to adopt in accordance with the Regulation "On adoption of minors and family upbringing (patronage)", approved by the Cabinet of Ministers of the Republic of Uzbekistan dated April 1999, 12 No 171 submits the following documents to the department:

application indicating the last name, first name, patronymic, place of residence, how long the couple has been married, living together or separately, their number and age if they have children, the age and sex of the adopted child;

identity document;

a copy of the marriage certificate (if married);

reference from the place of residence with indication of family members;

reference from the place of work indicating the salary;

a description of the place of work or residence;

conclusion of the medical-advisory commission on the health of the person wishing to adopt, references of psychiatric and narcological institutions, skin and genital diseases dispensary.

To prepare a conclusion on the possibility of adoption, the Department of Public Education draws up an act on the results of the study of the living conditions of persons wishing to adopt a child.

On the basis of the application and the attached documents, as well as the act of examination of the living conditions of persons wishing to adopt a child, the Department of Public Education within 30 working days from the date of application prepares a conclusion on their possibility of adoption . This conclusion is given to the applicant and is the basis for registration as candidates for adoption.
